The terms "CertTest", "we" and "our" refer to CertTest Training Center Inc and our staff. Terms of "you", "your" and "client" refer to the buyer representing the client organization and the attendee regardless of whether a corporation, same individual or multiple individuals. All dollar amounts stated in this notice are in U.S. Dollars.
Attendee Eligibility.
CertTest provides training for employees of business organizations, non-profits and government. We do not provide training for individuals unless sponsored by their employer. CertTest specializes in providing professional seminars exclusively for attendees sponsored by their organization and does not participate in state or federal training reimbursement programs. Unemployed persons should contact their local employment office for other training providers.
Seminar Content.
CertTest training materials undergo independent review to ensure the accuracy and effectiveness of our publications. Training materials are furnished at the start of the seminar. Certain events may have printed study materials available for shipping in advance of seminar start date. Training workbooks and practice exams are only issued during the seminar. Electronic versions of our materials are not available due to copyright limitations. Each seminar includes a pre-assessment and post assessment practice exam along with review exercises. Attendees will receive a class completion certificate with seminar transcript upon fulfilling the stated training objectives.
Seminar Availability & Scheduling.
Attendee substitutions are allowed for persons authorized by the buyer and employed at the same organization. CertTest reserves the right to cancel a seminar if we fail to reach the minimum paid enrollment of ten (10) attendees for the stated event. We also reserve the right to cancel or reschedule seminars at our sole discretion. CertTest will exercise best effort to provide your attendee with instruction on the date, location, and subject according to the confirmation letter provided after enrollment. Seminar completion certificate and transcript may be withheld pending receipt of full payment unless prior arrangements are made. Buyer and attendee grant us the right to report non-payment to the appropriate certification body which may disqualify certification. Our offer is for an instructor-led training seminar delivered by CertTest Training. CertTest liability and any possible refund shall not exceed the seminar fee paid, less CertTest cancellation fees and non-recoverable travel expenses paid by CertTest on behalf of the attendee. All dates are subject to prior sale and booked on a first paid, first served basis.
Life Safety Policy.
CertTest places life and safety as a top priority, therefore we will not be responsible for cancellation or reschedule due to war, terrorism, civil disturbance, severe weather threats, medical events, or other conditions deemed potentially unsafe by the sole discretion of CertTest management. We are not responsible for delays, force majeure, lost time, travel accidents, or other events outside of our control. Our policy is to exercise our best effort to provide training as scheduled and confirmed with our attendee. We will make every effort to provide on time seminars or provide alternate schedule for training delivery. Safety is our primary objective.
Seminars and travel in or through areas vulnerable to severe weather are subject to special conditions. Forecasting methods for Tropical storms and other Severe weather are known to be inaccurate beyond three days in advance. We understand as employers that your staff must not be willfully placed in harms way. Our strategy is to leave the area at the earliest possible opportunity long before official public announcements. Public officials may be overly concerned or hesitant about local economic impact ahead of safety. Relocating personnel, jobs and seminars is proven the most effective strategy for minimal business disruption, lowest risk and lowest cost solution to avoid loss. We intend to avoid the area until local conditions are favorable to for-profit business activities. By relocating early a business can safely remove staff operations, families and other assets in a calm affordable manner. We may return to normal operations after the area is fully restored to stable economic viable market with all related damage repaired and potential disruptive issues eliminated. CertTest adheres the forecast warnings of the U.S. National Ocean Atmospheric Agency (NOAA) and other experts not in conflict. We adhere to the following operating policy with regard to Hurricanes & Severe Weather.
For Hurricanes Tropical storms
We may interrupt, cancel or reschedule any event running or planned to start within 10 days of any announcement a storm if any of the following occur:
1) Storm path is forecast in the next 4 days or less to impact within 300 miles of the event location. Events held in
Florida will be canceled if the storm track is expected by meteorologists to traverse the Bahamas Islands or Cuba with projected travel towards our event location. This storm track will be presumed unless the actual path is known in advance.
2) Local, State or National authorities recommend, announce or authorize any voluntary storm preparations or mandatory evacuation.
3) Commercial airlines significantly delay, reroute or suspend flights for the area, preventing timely entry or exit.
4) Storm damage in the area which could prevent our ability to operate the event as planned.
Our tropical storm/hurricane policy is based upon a scenario involving the U.S. coast and we reserve the right to adjust this plan as necessary without prior notice or consent. Your act of registering to attend witnesses unconditional consent to these policy terms.
For Severe Weather
Severe weather includes Tornado, Heavy rain, High winds, Excessive heat or cold, Snow and Ice. Depending on the amount of advance notice and dependability of the information, CertTest may interrupt, cancel or reschedule any event due to severe weather.
Severe weather, Hurricane and Natural Disaster threats are interpreted as acts of god or act of nature. Strikes, Civil unrest, Travel disruption, Emergency conditions and Terrorist threats represent force majure beyond our control. In each of these events you will be solely responsible for all your costs incurred by the action and solely responsible to arrange for your attendees safety including evacuation. Events interrupted, canceled or rescheduled due to Life Safety are NOT eligible for refund. You may reschedule to attend another seminar at your own travel expense.
Substance Abuse & Disruptive Manner.
We reserve the right to deny admittance or dismiss persons from seminars due to any perceived substance abuse during our event. This includes disruptive manner, any appearance of intoxication or chemical influence. Persons we deny entry or dismiss are only eligible to reschedule for another event and by registering for a seminar you unconditionally agree to waive the right of any related refund.
Health Policy.
We reserve the right to deny admittance or dismiss persons from any event due to any perceived health related illness that may be considered disruptive or appears to be potentially contagious. Buyer and attendee grant CertTest and our Instructor the sole authority to make the decision. Persons we reschedule due to safety reasons, denied entry or forced dismissal are only eligible to reschedule for another seminar and by registering for attendence you unconditionally agree to waive the right of any related refund. An attendee’s health condition is a personal issue outside of the control of CertTest.
Payment Policy.
All seminars are to be paid in advance.CertTest does not accept walk in registration at the event. All amounts stated in this notice are in U.S. Dollars. Seats are not reserved unless we have received a form of payment negotiable for deposit at our bank. Payments may be made by major credit card, check, or cash in advance. Purchase orders are NOT considered payment. All seminar enrollments included a non-refundable $200.00 registration fee which is applied towards your event attendance fees. Unless CertTest cancels the event for reasons other than our Life Safety and Health Policy, you will be charged the non-refundable registration fee if you fail to attend the seminar for any reason. You can reschedule for a future seminar date in accordance with our Attendee Rescheduling & Cancellation policy listed below. Event dates are subject to cancellation unless payment has been made and the minimum number of attendees have registered for the same event date & location.
Invoice customers using "bill me" option will be invoiced at the retail with a discount for pre-payment. Seats are subject to prior sale and will not be confirmed until CertTest processes your payment for deposit to our bank. CertTest can invoice your company for the seminar cost, however the buyer and attendee are responsible for payment prior to the seminar. Sale prices on our website represent a purchase price for immediate payment or payment received within 7 days of registration before the event starts using check or credit card. Invoice will reflect a price equal to the retail price. Invoices accompanied by payment within 5 days of registration for 21 days prior to the seminar are eligible for the pre-payment discount, otherwise the full invoice amount is due. Attendee substitutions are allowed for persons authorized by the buyer and employed at the same organization. Credit cards provided as the backup commitment for payment will be charged for event fees prior to the start of seminar unless we received other payment by seven days prior to seminar starting date. CertTest does not reverse or refund credit card charges if your check payment arrives after the credit card is billed. We may charge credit cards for other fees due to your cancellation, reschedule or no-show.
Incomplete, Disputed or Failed Payment. In the event of returned checks or disputed credit cards we will allow three (3) business days for you to resolve the issue and redeem full payment to CertTest. We reserve the right to deny admittance or to notify the certification body that your seminar transcript or certificate may be subject to revocation for non-payment. Seminar attendance records, receipts, transcripts and certificates may be withheld by CertTest without any liability until buyer completely fulfills payment obligations to us.
Attendee Rescheduling & Cancellation Policy.
Seats in our training seminars are sold just like cabins on a cruise ship. We do not over book and have committed to hold your seat for you. A last minute cancellation or vacancy creates a loss of revenue with added expense for CertTest. Attendees that need to reschedule their seminar should call at least two weeks prior to the event start date. The more advance notice the better. We are happy to work with most requests and understand the extremely rare need to reschedule. All seminar enrollments include a non-refundable $200.00 registration fee which is applied towards your event attendee fees. Unless CertTest cancels the event for either unavailability to meet our minimum number of paid registered attendees or due to seminar date changes, you will be charged the non-refundable registration fee if you fail to attend the seminar for any reason.
Airfare & Hotel Paid by CertTest.
You will be responsible for all costs incurred if you fail to attend, miss designated travel times, forfeiture of travel commitment by actions or lack of timely action on your part, or cancel attendance. CertTest requires a minimum of three (3) business days as reasonable time to make any changes to CertTest paid travel. When CertTest paid travel arrangements are made, you will be responsible for the cost and consequence of all changes, loss or cancellation even if you reschedule for any reason. Our hotel agreement requires the traveler to present their own credit card at time of check-in for billing all incidental charges other than basic room fee plus tax. Incidental charges include applicable room deposits, internet usage, movies and all other charges. LIMITATION OF LIABILITY FOR TRAVEL by CertTest shall not exceed fifty dollars ($50.00).
Refund Policy.
Undisputed refund requests will be processed within 30 days using the same method as original payment, pending verification of funds clearing the bank. International payments will be processed within 30 working days depending on date original payment was received. Payments by check will be refunded by business check. Credit card payments can only be credit back to the same account. Updated merchant credit card processing regulations require the merchant to credit the account even if the account is closed, and the card company will handle returning any remaining balance. The final balance due will depend on the nature of the refund less any additional charges for non-show, cancellation, reschedule, travel or other outstanding obligations to CertTest. By registering for a CertTest event or travel promotion you unconditionally accept all the terms and conditions listed on this page.
Free Seminar Attendance Drawing.
We offer a Free admission drawing to help promote CertTest. No purchase is necessary to win. Making a purchase will NOT increase your odds of winning. Odds of winning are not calculated and dependent on total number of unique entries received by all participants. The winner is selected by random drawing. By entering the drawing, participants agree to receive email notices of our monthly event schedule along with any updated promotional information. Participants can opt-out at any time to cancel their entry and stop transmission of free drawing announcements. Winner is responsible for all travel costs incurred to attend our seminar including applicable taxes. CertTest airfare promotion does not apply to drawing winners. Special Promotions.
CertTest may offer a variety of promotions to attract business. Our goal is to attain the optimum number of students for each seminar event. Special offers and price changes apply only to new registrations; attendees already registered are not eligible for any type of refund nor the difference in price. You may or may not be able to participate in special offers depending on the rules of each promotion including eligibility criteria and applicable dates. You will have certain responsibilities and timely duties in order to participate. We shall not be liable for your actions or inactions related to participation in our promotion. Your failure to meet the eligibility criteria or deadlines will disqualify a full refund. You will be obligated to indemnify CertTest for actual costs incurred to service your request for participation and you authorize these costs to be deducted from any refund amount.
Limitation of electronic devices.
To ensure the maximum learning experience for all attendees with minimal distractions, CertTest does not allow the use of the following during our seminar: laptops, PDA, cell phones, wireless devices or electronic recording apparatus. We do allow devices to assist handicapped individuals as required by the American Disabilities Act section 502 under the condition such devices are not used for the purpose of recording our presentation. Attendees may not use photographic devices to record training activities or presentations without expressed written consent of CertTest. Requests for CertTest's written consent should be made at least thirty days (30) prior to the event date.
Intended Use.
CertTest provides independent training in accordance with PMI training standards. CertTest can not ensure or guarantee anyone will be able to meet all the requirements necessary to be certified or remain certified since the certifying organization is not under our influence or control. Past attendees with the proper documented experience, adequate study and credentials usually achieve certification. CertTest makes no warranties, expressed or implied, pertaining to your intended use. CertTest does not offer refunds based on denied certifications. Our product is specific time spent assisting your studies for which CertTest is entitled to receive compensation. The exam is a best effort event. Proving applicable work experience and proper study is the responsibility of the attendee.
Limitation of Use.
CertTest developed training materials, exercises and all other materials distributed by CertTest are subject to copyright laws both international and domestic. CertTest grants limited license to use our materials for personal home study by our individual attendees. No other rights are licensed under this agreement. No intellectual property rights are transferred or assigned under this agreement. The attendee and buyer are not authorized to reproduce any CertTest materials. CertTest does not train competing instructors for another organization. Special exceptions are available for full time accredited college professors. A competing instructor is defined under this agreement as anyone offering training in subjects similar to CertTest. Buyer and attendee warrant they shall not participate as instructors for training similar to those offered by CertTest. Any requests for clarification must be made prior to registering. Your action of registration to attend a CertTest event evidences your unconditional consent this limitation.
Limitation of Liability.
No warranties expressed or implied are made with regard to fitness of use for a particular situation. CertTest is dedicated to provide you with our best effort to deliver seminar training for your attendee. We cannot guarantee the results of an individual, their ability to learn the subject material or ability to pass their individual certification exam. Our maximum financial liability including all possible damages is limited to only the event fee paid to CertTest. All expenses of the attendee including travel and lost time represent inherent risks that are the sole responsibility of the buyer. CertTest shall be held harmless without any form of liability for your costs of travel, hotel, rental transportation, wages, work days missed, illness, injury, lost business, or related expenses in attending the CertTest class. By registering for our seminar the buyer and attendee unconditionally agree to indemnify CertTest for all legal costs related to any legal action by yourself, your organization, employees, attendees and any related persons including heirs or those that may claim through you. All parties consent that any legal actions which arise shall be exclusively bound to confidential arbitration under the rules of the American Arbitration Association in the venue of Dallas County in the State of Texas without motion for change of venue. By registering for this event you unconditionally agree to these terms and represent you have the authority to bind your organization, and further agree these terms shall supersede and render void any conflicting terms specified in your purchase order.
